Who We Are

SportZtars Inc. ("SportZtars," "we," "us," or "our") operates the SportZtars mobile application for iOS, Android, and Apple Watch (the "App"), the website at sportztars.com (the "Site"), our corporate wellness programs, and our text message and email programs (together, the "Services"). This policy explains what information we collect through the Services, how we use and share it, and the choices and rights you have.

By downloading, registering with, or using the Services, you agree to this policy. If you do not agree, please do not use the Services. This policy should be read together with our Terms and Conditions and our SMS Terms.

Information You Give Us

Account information. Your name, email address, mobile phone number, password, and profile details such as a username and photo.

Wellness and activity information you choose to provide. Fitness goals, workouts and programs you complete, challenge and BattleZtars results, meditation and breathwork activity, and any nutrition or health details you share when you book a session with one of our nutritionists or coaches.

Content you post. Messages, chats, photos, videos, reviews, and other material you create or share in the App ("Contributions").

Contacts. If you choose to invite friends, and only with your permission, we access the contacts you select so you can send an invitation.

Communications and forms. Information you send when you contact us, request a demo, sign up for a class, subscribe to a newsletter, request account deletion, or opt in to text messages on the Site.

Information We Collect Automatically

Location. With your permission, precise location from your device, used to show nearby games, classes, and events and to help you join local BattleZtars games. You can turn location access off at any time in your device settings.

Usage information. The features you use, content you view, searches you run in the App, and how you interact with the Services.

Device and identifier information. Your user ID, device ID, device type, operating system, app version, IP address, and, where permitted, advertising identifiers.

Diagnostics. Crash reports and performance data that help us find and fix problems.

Cookies and similar technologies. On the Site we use cookies, pixels, and analytics tools to understand traffic, remember preferences, protect our forms from spam, and measure our advertising. You can control cookies through your browser settings.

Purchases and Subscriptions

Memberships and in-app purchases are processed by Apple (App Store) or Google (Google Play). We receive a record of what you purchased and your subscription status, but we do not receive or store your full payment card number. Your payment information is handled under Apple's or Google's own privacy policy.

How We Use Your Information

We use your information to create and run your account; to deliver workouts, classes, programs, challenges, and bookings; to personalize your experience and recommendations; to process memberships and purchases; to send account, booking, and service notices; to send marketing emails and, only with your express consent, marketing text messages; to provide customer support; to run our corporate wellness programs; to measure and improve the Services; to deliver and measure advertising; to keep the Services safe and prevent fraud and abuse; and to comply with the law.

Advertising and Tracking

We and our advertising and analytics partners may use usage information and identifiers to measure our marketing and to show you SportZtars ads on other apps and websites. On iOS, we only use your device's advertising identifier for this purpose if you allow it through Apple's App Tracking Transparency prompt. On Android, you can reset or delete your advertising ID in your device settings. On the Site, you can block or delete cookies in your browser. We do not sell your personal information for money.

How We Share Your Information

We share information only as described here:

• Service providers that host, store, and process data for us, provide analytics and crash reporting, send email and text messages on our behalf, and support customer service. They may use your information only to perform services for us.
• Coaches, trainers, and nutritionists you book with, who receive the details needed to deliver your session.
• Other users, who can see your profile, the Contributions you post, and your participation in public games, challenges, and leaderboards.
• Your employer, if you join through an employer or benefits program. We may share your enrollment status and aggregated or de-identified participation reports. We do not share your individual workout, nutrition, or health details with your employer unless you ask us to.
• Apple and Google, to process purchases and subscriptions.
• Advertising and analytics partners, as described in the Advertising and Tracking section above.
• Legal and safety, when we believe disclosure is required by law, court order, or government request, or is needed to enforce our terms or protect the rights, property, or safety of SportZtars, our users, or others.
• Business transfers, to a buyer or successor in a merger, acquisition, financing, reorganization, or sale of assets, subject to this policy.
• With your consent, or at your direction.

We may share aggregated or de-identified information that cannot reasonably identify you without restriction.

Text Messages and Mobile Information

If you opt in to SportZtars text messages, we use your mobile number to send the messages you signed up for, as described in our SMS Terms. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We share mobile numbers only with the service providers that deliver our text messages, and only to deliver them. The categories of sharing listed above do not apply to your text messaging opt-in data or consent.

Your Choices

• Email: use the unsubscribe link in any marketing email.
• Text messages: reply STOP to any message.
• Push notifications: turn them off in your device settings.
• Location, contacts, camera, and photos: grant or revoke access at any time in your device settings.
• Ad tracking: manage it through App Tracking Transparency on iOS, your advertising ID settings on Android, and your browser's cookie settings.

Accessing, Correcting, and Deleting Your Information

You can review and update most of your information in your profile in the App. You can request a copy of your information, a correction, or deletion by emailing support@sportztars.com.

To delete your account and the personal information associated with it, use our account deletion page or email support@sportztars.com from the address on your account. Deleting the App from your phone does not delete your account. If you have an active membership, cancel it in your App Store or Google Play subscription settings so you are not billed again.

Data Retention

We keep your personal information for as long as your account is active or as needed to provide the Services. When you close your account or ask us to delete your data, we delete or de-identify your personal information within 90 days of your request, except where we must keep it to meet legal, tax, accounting, or regulatory obligations, resolve disputes, prevent fraud and abuse, or enforce our agreements. Information kept for those limited purposes is kept only as long as necessary and then securely deleted or anonymized.

Residual copies may remain in secure backups for a limited additional period until those backups are overwritten in the normal course of operation. Aggregated or de-identified information that can no longer reasonably identify you may be kept longer for analytics and to improve the Services.

Data Security

We use administrative, technical, and physical safeguards designed to protect your information, including encryption of data in transit. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please keep your password confidential and let us know right away if you believe your account has been compromised.

Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete it. If you believe a child under 13 has given us information, contact us at support@sportztars.com.

Your State Privacy Rights

Depending on where you live, including California, Colorado, Connecticut, Virginia, Texas, Oregon, and other states with consumer privacy laws, you may have the right to know what personal information we collect, use, and disclose; to access and receive a copy of it; to correct it; to delete it; and to opt out of targeted advertising, the sale of personal information, and certain profiling. California residents may also request information about disclosures for direct marketing purposes.

We do not sell personal information for money. To the extent our use of advertising partners is treated as "sharing" or "targeted advertising" under your state's law, you can opt out by emailing support@sportztars.com with the subject line "Do Not Sell or Share."

To make any request, email support@sportztars.com. We will verify your request using information associated with your account and respond within the time required by law. You may use an authorized agent, and you may appeal our decision by replying to our response. We will not discriminate against you for exercising your rights.

Health Information

SportZtars is a consumer wellness service and is not a healthcare provider or a health plan, so the wellness information you share with us is generally not covered by HIPAA. We treat it with care: we use it only to provide and personalize the Services you request, we do not sell it, and we do not use it for advertising.

Users Outside the United States

SportZtars is based in the United States, and your information is processed and stored in the United States. If you use the Services from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your country.

Changes to This Policy

We may update this policy from time to time. We will post the updated policy on this page and change the "Last updated" date above. If we make material changes, we will notify you in the App, by email, or by another reasonable method before the change takes effect.
